Events Agreements

TERMS AND CONDITIONS OF ATTENDANCE AND PARTICIPATION AT CALIFORNIA MORTGAGE BANKERS ASSOCIATION (California MBA) EVENTS/CONFERENCES

By registering for California MBA Events, you are agreeing to these terms, which form a legal contract between the California Mortgage Bankers Association ("California MBA"), and the registered attendee and/or participant (“You”). If you are registering on behalf of another it is your responsibility to ensure that the person attending is aware of these terms and accepts them, and by completing the registration you are warranting that you have made the attendee aware of these terms and that they have accepted these terms.

1. Event Admission

1.1. Admittance. Your registration entitles You to admittance to the Event. Any and all other costs associated with your attendance (including without limitation any travel and/or accommodation expenses) shall be borne solely by You and the California MBA shall have no liability for such costs.

1.2. Termination. The California MBA and Management reserve the right to deny entry to Event or remove from Event any person who is behaving or threatening to behave in a manner in which Management, in its sole and absolute discretion, considers to be disruptive of Event or to its attendees.

1.3 Media and Likeness. By participating in the Event, you agree to grant permission to the rights of your image, likeness and sound of your voice as recorded on audio or video tape without payment or any other consideration. You understand that your image may be edited, copied, exhibited, published or distributed and You waive the right to inspect or approve the finished product wherein your likeness appears. Additionally, you waive any right to royalties or other compensation arising or related to the use of your image or recording. You also understand that this material may be used in diverse educational settings within an unrestricted geographic area. Photographic, audio or video recordings may be used for the following purposes: conference presentations, educational presentations or courses, informational presentations or workshops, on-line educational courses, presentations, or workshops, educational videos, and social media.

1.4. Event Content. You acknowledge and agree that the California MBA, in its sole discretion, reserves the right to change any and all aspects of the Event, including but not limited to, the Event name, themes, content, program, speakers, performers, hosts, moderators, and time.

1.5. Partnered Events Agreement. You acknowledge and agree that the California MBA may share your contact information (name, college, and email) with other partnered organizations of this event. The information collected will only be shared for outreach and communication by any partnered organization related to the event. All other uses of your contact information are strictly prohibited.

2. Fee(s)

2.1. Payment. The payment of the applicable fee(s) for the Event is due upon registration. If such payment is insufficient or declined for any reason the California MBA may refuse to admit You to the Event and shall have no liability in that regard.

3. Cancellations

3.1. Cancellations. Cancellations are subject to the event registration fee, minus the processing fees which are final. Please note that if you do not cancel and do not access the event, you are still responsible for payment. In no event shall the California MBA be obligated to refund all or a portion of the registration fee. Please note the cancellation policy will be noted on each event website and confirmation email.

3.2 Force Majeure.  The California MBA will not be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement when and to the extent such failure or delay is caused by or results from acts beyond the California MBA’s reasonable control, including, without limitation, the following: acts of God, strikes, boycotts, labor disputes, government requisitions, restrictions or war or apparent act of war, terrorism, disaster, civil disorder, epidemic or pandemic, curtailment or restriction on transportation facilities, or any other comparable calamity, casualty or condition (collectively a “Force Majeure”). California MBA shall have the right to immediately terminate the affected Event without liability and shall be relieved of its obligations to You.  

4. Photo Release Information

California MBA Conference, Meeting, and Event Code of Conduct

California MBA (“CMBA”) is committed to creating and maintaining an engaging and productive conference, meeting and event environment, in which all individuals are treated with respect and dignity, and one that is welcoming and free from any form of harassment, discrimination or other inappropriate conduct. This Conference, Meeting and Event Code of Conduct (“Event Code of Conduct”) applies to and guides everyone who participates in or attends CMBA conferences, meetings or events, including members, non-members, employees, speakers, sponsors, vendors, contractors, volunteers and guests (“Attendees”). CMBA wants to ensure that all Attendees understand what behavior is expected and what behavior will not be tolerated at, or in the environment of, a CMBA conference, meeting or event. This Event Code of Conduct covers conduct that occurs during a conference, meeting or event, as well as conduct that may occur outside of the actual conference, meeting or event schedule. This Event Code of Conduct is intended to cover any conduct engaged in by an Attendee, regardless of whether such conduct is directed at another Attendee or at a non-Attendee. The facilities covered by this Event Code of Conduct include any venue, hotel, meeting room or CMBA office location where a CMBA-sponsored conference, meeting or another type of event takes place, as well as at off-site locations where conference-related social or other events take place. For this Event Code of Conduct, CMBA-sponsored conferences, meetings and other events will be referred to as “Events” in the plural and “Event” in the singular.

EXPECTED CONDUCT

CMBA expects that Attendees will:

  • Be considerate and respectful to each other and to others they interact with;
  • Refrain from harassing, discriminatory or inappropriate conduct; and
  • Alert a member of CMBA management or staff if they observe any conduct that violates this Event Code of Conduct.

UNACCEPTABLE CONDUCT

CMBA expressly prohibits harassment and discrimination based on race, color, religion, national origin, sex, age, pregnancy, genetic information, military and veteran status, marital status, personal appearance, gender identity or expression, sexual orientation, disability or perceived disability (physical or mental), family responsibilities, political affiliation or any other characteristic legally protected against discrimination or harassment.

Examples of conduct prohibited by this Event Code of Conduct include, without limitation:

  • Sexist, racist, homophobic or other discriminatory jokes, slurs, insults or comments;
  • Unwelcome sexual advances, whether verbal or physical;
  • Display of sexualized images;
  • Stalking, whether in person or online;
  • Threatening or intimidating language or physical conduct, including any verbal or physical altercation; and
  • Inappropriate photography or recording without consent.

REPORTING PROCEDURE

If any Attendee believes s/he or another Attendee has been subject to conduct that violates this Event Code of Conduct, or witnesses such conduct, s/he should report the violation to a member of CMBA management or staff while on-site at the event or as soon after the event as possible. Any member of CMBA Event staff who receives such a report or who witnesses inappropriate conduct must notify a member of CMBA management as soon as possible. All reported concerns will be treated seriously and investigated promptly. All Attendees are expected to cooperate fully and honestly with any investigation.

CONSEQUENCES

Attendees asked to stop any conduct that CMBA deems contrary to this Event Code of Conduct are expected to comply immediately. At CMBA’s sole discretion, and without any obligation to do so, violations of this Event Code of Conduct may result in immediate removal from, or denial of access to, the CMBA sponsored Event without a refund of any applicable registration fees, and/or disqualification from attendance at future Events. Moreover, nothing in this Event Code of Conduct shall prevent CMBA from taking any other legally permissible action to enforce its terms. 

NO RETALIATION

CMBA will not tolerate any actual or attempted reprisals or retaliation against individuals who raise in good faith a concern that this Event Code of Conduct has been violated, or who participate in the investigation of such a concern. CMBA takes all allegations of conduct in violation of this Event Code of Conduct, including harassment and discrimination, seriously and is committed to ensuring an Event environment that is free of any such conduct.
